These Terms & Conditions (“Terms”) govern your access to and use of the Toymersive website https://www.toymersive.com/ (the “Site”) and your purchase of products available through the Site.

The Site is operated by Nextor Ventures Private Limited, a company registered in India. By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms. Please read them carefully before using the Site or making a purchase.

ELIGIBILITY & USE OF THE SITE

You may use the Site only for lawful purposes and in accordance with these Terms.

If you create an account or place an order, you confirm that the information provided by you is accurate, complete, and up to date. Our Site and account functionality are intended to be used by adults, including parents or guardians purchasing products on behalf of children.

You agree not to:

  • Use the Site for any unlawful or unauthorised purpose

  • Attempt to gain unauthorised access to the Site or its systems

However, actual product colours may vary slightly depending on your device, screen settings, lighting, photography, or manufacturing processes.

Packaging, product illustrations, component arrangements, and other visual representations may also differ slightly from the final product.

The product information displayed on the Site should be considered indicative unless specifically stated otherwise.

PRICING & AVAILABILITY

All product prices displayed on the Site are subject to change without prior notice.

Unless otherwise stated, all prices displayed on the Site are inclusive of applicable GST. We may correct pricing, product information, availability, or other errors on the Site at any time.

In the event that a product has been listed at an incorrect price or with incorrect information due to a technical or human error, we reserve the right to cancel or modify the affected order. Where payment has already been made, the applicable amount will be refunded to the original payment method, subject to applicable payment-provider processes.

Product availability is not guaranteed until an order has been successfully placed and accepted by us.

ORDERS & ORDER ACCEPTANCE

When you place an order through the Site, you are making an offer to purchase the selected products.

After receiving your order, we may send you an order confirmation acknowledging that we have received your request. An order confirmation does not necessarily constitute final acceptance of the order. An order is deemed accepted only when we dispatch the product or otherwise notify you that your order has been accepted.

We reserve the right to accept, reject, limit, or cancel an order for reasons including:

  • Product availability

  • Pricing or listing errors

  • Payment issues

  • Incorrect or incomplete customer information

  • Suspected fraudulent or unauthorised activity

If we cancel an order after payment has been received, we will initiate an applicable refund.

PAYMENT

Payments made through the Site are processed through our authorised third-party payment provider.

By placing an order, you agree to provide valid and accurate payment and billing information.

We do not store your complete credit card, debit card, UPI, or banking credentials on our own servers. Payment processing is subject to the terms, policies, and security practices of the relevant payment provider.

An order will generally be processed only after successful confirmation of payment, unless otherwise stated.

SHIPPING & DELIVERY

We currently offer shipping within India.

Delivery timelines displayed on the Site or communicated during the order process are estimates and may vary depending on the delivery location, availability of products, logistics partners, weather conditions, public holidays, or circumstances beyond our reasonable control.

Once an order has been dispatched, delivery is handled by our shipping or logistics partners.

Toymersive will make reasonable efforts to ensure timely delivery but cannot guarantee delivery on a specific date unless expressly stated. We shall not be liable for delays or failures arising from events beyond our reasonable control, including natural disasters, floods, fires, strikes, epidemics, government actions, internet failures, logistics disruptions, power failures, or similar events.

You are responsible for providing a complete and accurate delivery address and contact details. Delays or failed deliveries caused by incorrect or incomplete information may not be attributable to Toymersive.

Customers should inspect the package upon delivery and notify us promptly if the package appears tampered with or damaged. Additional details regarding shipping, delivery charges, and applicable service areas may be provided in our Shipping Policy.

RETURNS, EXCHANGES & REFUNDS

Returns, exchanges, cancellations, and refunds are subject to our applicable Returns & Refund Policy. Where eligible, customers must follow the process and timelines specified in that policy.

Products may be subject to specific conditions for exchange, including requirements relating to product condition, packaging, missing components, proof of purchase, or other applicable criteria. We reserve the right to reject an exchange request where the applicable requirements have not been met.

Where a refund is approved, the refund will be processed through the applicable payment method or channel and may be subject to processing timelines determined by the relevant payment provider or financial institution.

CANCELLATION OF ORDERS

You may request cancellation of an order by contacting us at info@toymersive.com.

Cancellation requests can only be accommodated where the order has not already been processed or dispatched. Once an order has been dispatched, cancellation may no longer be possible and the request may instead be handled under our applicable Returns & Refund Policy.

INTELLECTUAL PROPERTY

All content available on the Site, including but not limited to:

  • Brand names and logos

  • Product names

  • Product images

  • Illustrations

  • Graphics

  • Photography

  • Text and copy

is owned by or licensed to Nextor Ventures Private Limited and is protected by applicable intellectual-property laws.

Toymersive and related brand assets may not be used in connection with any third-party product, service, website, or activity without our written consent.

USER REVIEWS & CONTENT

Where the Site allows you to submit reviews, feedback, photographs, comments, or other content (“User Content”), you are responsible for ensuring that the content you submit is accurate and does not violate any applicable law or the rights of others.

By submitting User Content, you grant Toymersive a non-exclusive, royalty-free, worldwide licence to use, reproduce, display, publish, adapt, and distribute that content for purposes related to operating, promoting, and improving our business and products.

You must not submit content that is unlawful, misleading, defamatory, abusive, obscene, infringing, or otherwise inappropriate. We reserve the right to remove User Content that violates these Terms or applicable law.
